RISKS AND REWARD OF USING IP IN CHINA & EAST ASIA

IP protection remains a top priority for companies sourcing goods in China and East Asia as well as generating new IP through local R&D facilities.  These countries are also now an increasingly important source of revenues from direct sales and IP licensing – but they are known as hotbeds of counterfeiting and pirating.  Is it worth risking key technology to tap these markets?  What are the pitfalls and how should they be handled?

U.S. and international IP practitioner, MIKIO ISHIMARU of Ishimaru & Associates, San Jose, will be joined by China/Asia practitioners JOE SIMONE and TROY RICE of Simone IP Services (SIPS Asia), Hong Kong, to share their experience and insights in a Roundtable discussion on these and other timely topics.  The Roundtable format offers an opportunity for participants to share their own concerns and best practices on China/East Asian patent and trademark topics of interest.

TOPICS

IP Protection in China:  Joe and Troy will provide an overview of the latest legislative developments impacting patent and trademark filing in China as well as enforcement strategies.  They will also discuss best practices in enforcing trademarks and patents.

Illegal Patent Applications:  Other countries under certain circumstances make the filing of the first patent application outside that country illegal.  Mikio will discuss risks in filing patents in East Asia.  Come and learn how to stay out of trouble.

SPEAKERS

Our speakers bring to the discussion over three-quarters of a century of first-hand knowledge of IP challenges in China and other East Asian countries, as well as in the US.

Mikio Ishimaru:  Mikio already had extensive engineering and in-house legal experience when he founded the predecessor of Ishimaru & Associates in 1997.  He has managed numerous law suits including patent, trademark, copyright, and product liability suits.  Learn More

This was the inaugural event of the Asian Pacific American Bar Association (APABA)-SV IP Committee. Congresswoman Zoe Lofgren was present and gave an update about the new USPTO Satellite office. Congresswoman Lofgren was involved with the Online Piracy Act, the American Innovation in Manufacturing Act, the Amerasian Paternity Recognition Act among others.
